Terms of Service

To ensure clarity, the following definitions apply: • "Host": Any user who registers to search for services, post events, or book Service Providers. • "Service Provider": Any business, freelancer, or entity registered to list services and accept bookings. • "Service": The specific event service provided by the Service Provider (e.g., Catering, Decor, Photography). • "Booking": A confirmed agreement between a Host and Service Provider initiated through the Eve-25 platform. • "Agreed Price": The final, negotiated cost for a Service, confirmed by both parties within the Platform.

2.1. We Are a Marketplace, Not a Provider. Eve-25 is a digital venue that facilitates connections between Hosts and Service Providers. We do not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Host Services or Event Services. 2.2. No Employment Relationship. Service Providers are independent contractors, not employees, agents, or partners of Eve-25. We do not direct or control their day-to-day operations, safety protocols, or service quality. 2.3. Assumption of Risk. You acknowledge that planning events involves inherent risks. By using Eve-25, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members or third parties will be limited to a claim against the particular Member or third party who caused you harm. You agree not to attempt to impose liability on, or seek any legal remedy from, Eve-25 with respect to such actions or omissions.

3.1. Eligibility. You must be at least 18 years old to create an account. By registering, you warrant that you are of legal age to form a binding contract in Botswana. 3.2. Verification & Truthfulness. Service Providers: You agree to provide accurate information regarding your business identity, location, and capabilities. Providing false portfolios (e.g., photos of work you did not do) is a material breach of these Terms and will result in immediate termination. Hosts: You agree to provide accurate details regarding your event dates and requirements. 3.3. Account Security. You are responsible for maintaining the confidentiality of your password. You are responsible for all activities that occur under your account.

4.1. The "Agreed Price" Mechanism. Eve-25 allows for dynamic pricing. A quote provided by a Service Provider is an estimate. The price is only final when: • The Host sends a formal Booking Request. • The Service Provider accepts the request. • Both parties confirm the "Agreed Price" within the platform's chat or booking interface. 4.2. Binding Contract. Once a booking is confirmed on Eve-25, a legally binding contract is formed directly between the Host and the Service Provider. Eve-25 is not a party to that contract.

5.1. Direct Settlement. At this stage of our beta launch, Eve-25 does not process payments. Hosts and Service Providers are solely responsible for arranging payment methods (e.g., Cash, E-Wallet, Bank Transfer, Cheque). We strongly recommend documenting all payments with receipts. 5.2. No Liability for Non-Payment. Eve-25 is not a debt collector. We are not liable if a Host fails to pay a Service Provider, nor are we liable if a Service Provider fails to refund a Host. 5.3. Deposit Warnings. We advise Hosts to exercise caution when paying large deposits directly to Service Providers. We recommend using the Platform's review system to vet Service Providers before transferring funds.

6.1. Service Provider Policies Rule. Because payments are handled off-platform, refund policies are set by the individual Service Provider. The Host is responsible for reading the Service Provider's cancellation policy (displayed on their profile) before booking. 6.2. Disputes. While Eve-25 cannot force a refund, we act as a trusted mediator. • If a Service Provider fails to show up ("No-Show"), the Host must report this to hello@eve25.com within 24 hours. • Verified "No-Shows" will result in the Service Provider being banned from the Platform to protect future users.

To maintain a safe and professional environment, the following is strictly prohibited: • "Ghosting": Service Providers accepting a booking and then ceasing communication without notice. • Portfolio Fraud: Uploading images of events, decor, or food that you did not produce. • Circumvention: Using Eve-25 to find a client and then asking them to cancel the platform booking to avoid building reputation history (this hurts your own long-term trust score). • Harassment: Any abusive language, threats, or discrimination based on race, gender, tribe, or religion. Violation of these rules will result in immediate account suspension.

8.1. User Content. Service Providers retain ownership of the photos they upload. However, by uploading content, you grant Eve-25 a non-exclusive, worldwide, royalty-free license to display, modify (for formatting), and promote your content for marketing purposes (e.g., "Service Provider of the Week" social media posts). 8.2. Platform IP. The design, code, logo, and architecture of Eve-25 are the sole property of Eve-25. You may not copy, scrape, or reverse-engineer any part of the Platform.

9.1. Verified Reviews Only. Reviews may only be submitted by Hosts who have completed a booking with the Service Provider. 9.2. Integrity. Service Providers may not coerce Hosts into leaving positive reviews. Hosts may not threaten to leave a negative review to extort free services or discounts ("Review Blackmail"). 9.3. Removal. Eve-25 reserves the right to remove reviews that violate our Content Policy (e.g., containing hate speech or proven falsehoods), but we do not remove reviews simply because they are negative.

PLEASE READ THIS SECTION CAREFULLY. 10.1. "As Is" Service. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE ACCURACY OF SERVICE PROVIDER LISTINGS OR THE SUITABILITY OF A SERVICE PROVIDER FOR YOUR SPECIFIC EVENT. 10.2. Liability Cap. TO THE MAXIMUM EXTENT PERMITTED BY BOTSWANA LAW, EVE-25 SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR SERVICE INTERRUPTION, ARISING OUT OF YOUR USE OF THE PLATFORM. 10.3. Specific Event Liability. EVE-25 IS NOT RESPONSIBLE FOR THE QUALITY OF FOOD, THE SAFETY OF TENTS, THE CONDUCT OF SECURITY GUARDS, OR ANY OTHER SERVICE PROVIDED BY SERVICE PROVIDERS. ALL DISPUTES REGARDING SERVICE QUALITY ARE BETWEEN THE HOST AND THE SERVICE PROVIDER.

You agree to release, defend, indemnify, and hold Eve-25 and its affiliates harmless from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of: • Your breach of these Terms. • Your improper use of the Platform. • Your interaction with any Member or participation in an Event (including any injuries, losses, or damages of any kind).

We respect your privacy. By using the app, you consent to our collection and use of your personal data as outlined in our Privacy Policy. We collect only the data necessary to facilitate bookings (Name, Phone Number, Event Location) and do not sell your data to third-party advertisers.

Eve-25 reserves the right to modify these Terms at any time. If we make changes, we will post the revised Terms on the Platform and update the "Effective Date" at the top. Your continued use of the Platform constitutes acceptance of the revised Terms.
